Arrested in Medan, Detained for 20 Days

Investigators from the Deputy Attorney General for Special Crimes (Jampidsus) at Indonesia's Attorney General's Office (Kejagung) named AL (Anwar Lawden), director and corporate secretary of PT Toba Pulp Lestari (TPL) Tbk, as a suspect in an alleged transfer-pricing corruption case spanning 2008–2025.

The determination is set out in Jampidsus Investigation Director Determination Letter No. TAP-55/F.2/Fd.2/10/2026 dated 15 October 2026. Kejagung's Head of the Center for Legal Information (Kapuspenkum) Anang Supriatna announced the case development in an official statement on Friday (16/10/2026).

"We are naming one suspect on Thursday, 15 October 2026, namely AL, who is the Director and Corporate Secretary of PT TPL," Anang said in Jakarta.

Before being named a suspect, AL was arrested in Medan, North Sumatra, on Thursday (15/10/2026). The forced arrest was carried out because AL had failed to answer investigators' summons. After his arrest, AL was brought to Jakarta and detained for 20 days, from 16 October to 4 November 2026, at the Salemba Detention Center, Kejagung branch.

Under-Invoicing Through HS Code Manipulation

Anang explained that in running its business, PT TPL sold pulp for export to its affiliate DP MMI, Ltd., and supplied product to the APR mill in the domestic market. Suspect AL allegedly committed unlawful under-invoicing by changing or manipulating the product's Harmonized System (HS) code.

"Suspect AL then unlawfully carried out under-invoicing by changing/manipulating the HS Code of the product, which by its characteristics, use, and market price should have been dissolving pulp, but was changed to paper grade pulp / bleached hardwood kraft pulp (BHKP)," Anang explained.

PT TPL was in fact obliged to submit transfer-pricing documentation (TP Doc) and its Corporate Tax Return to the Listed Companies Tax Office (KPP PMB) at the Directorate General of Taxes so its transactions could be tested for fairness. The submitted reports, however, did not match actual conditions. Investigators also allege AL paid money to tax examiners so the company would avoid supervision.

State Losses of IDR 2 Trillion

"The actions of Suspect AL together with the tax examiners resulted in state financial losses of approximately IDR 2 trillion," Anang asserted.

The suspect determination followed the examination of 116 witnesses, the seizure of documents and electronic evidence under district court authorization, and statements from experts in criminal law, state finance, and the pulp and cellulose industry. As an initial recovery of state losses, investigators have deposited IDR 500 million into the Jampidsus Other Government Account (RPL) from the Directorate General of Taxes (DJP).

Besides AL as an individual, investigators also named PT Toba Pulp Lestari itself as a corporate suspect in the case. AL was charged under Article 603 in conjunction with Article 20 letter a or c of Law No. 1 of 2023 on the Criminal Code, in conjunction with Article 18 of Law No. 31 of 1999 on the Eradication of Corruption Crimes, in conjunction with Law No. 20 of 2001.
