A week after the shooting by the U.S. Immigration and Customs Enforcement (ICE) in New York City, the victims of the shooting are still struggling to get medical care.Oscar Belgal, 28, a citizen of the Dominican Republic, has a bullet still in his neck and needs an emergency surgery, according to his team of lawyers.

The incident occurred on Thursday (8/10/2026) around 4 p.m. at Marble Hill, Manhattan — a small border area of the Bronx. Two ICE agents dressed in a coveted suit approached the Belgal-driving Honda CR-V; one agent broke the driver’s glass. After the car came out of the NYPD surveillance camera frame, an agent fired at least seven shots at the car. The bullet penetrated the front glass and touched Belgal’s neck under his left ear.

The 5-year-old Belgal was injured, and the Department of Homeland Security (DHS) said agents did not know that there was a child in the car. Belgal is now detained at the Metropolitan Detention Center, Brooklyn, in a condition that his lawyers from the Legal Aid Society and Make the Road New York said was very concerned — a shelter of isolation with minimal food and medical care.

On Wednesday (14/10/2026), a team of Belgal lawyers filed a habeas corpus petition to the federal court, demanding release or at least adequate medical treatment for their clients. A federal judge then blocked the temporary deportation and transfer of Belgal from detention facilities. The investigation into the shooting is now running on three routes: the FBI, Homeland Security Investigations, and the Bronx Prosecutor’s Office led by Prosecutor Darcel Clark.

DHS defended the actions of its agents. Homeland Security Minister Markwayne Mullin called Belgal an “illegal alien criminal” with a link to the Trinitarios gang and a history of arrest — theft, persecution, drugs, weapons, to heavy theft. DHS claimed Belgal made his vehicle a weapon and crashed into two ICE vehicles. Belgal’s lawyer strongly denied the version, calling his client panicked by being approached by a masked armed man who he did not recognize as the device.

The case sparked political clashes between New York Mayor Zohran Mamdani and President Donald Trump’s administration. Mamdani criticized ICE agents dressed as construction pirates and stated that the agents “see the law only as advice”. He ordered a 24-hour review of the NYPD police response, the use of private parking space as a gathering point for ICE operations, as well as the handling of post-event protests.

Trump and Mullin had hours of telephone conversations with Mamdani on the night of the incident, offering the transfer of Belgal prisoners to the NYPD police — but no deal was reached, and Belgal remained in federal custody.
