Roy Suryo's Objection Rejected, Jokowi Degree Trial to Continue

The panel of judges at the East Jakarta District Court (PN) rejected the objection (eksepsi) filed by Roy Suryo in an alleged defamation and Electronic Information and Transactions Law (UU ITE) violation case concerning accusations that the bachelor's diploma of the 7th President of the Republic of Indonesia, Joko Widodo, was fake.

The interlocutory decision was read out by Presiding Judge Christina Endarwati on Monday (19/10/2026). With this ruling, the indictment by the Public Prosecutor (Jaksa Penuntut Umum / JPU) was declared legally valid, and the case proceeds to the witness examination phase.

'Judged, first, declaring that the objection raised by the attorney of Defendant Dr. Kanjeng Raden Mas Tumenggung Roy Suryo Notodiprojo is inadmissible,' Christina stated while reading the verdict. The panel also ordered the Public Prosecutor to proceed with the examination of case number 300/Pid.B/2026/PN Jakarta Timur and to defer court costs until the final verdict.

Pretrial Ruling Does Not Invalidate Indictment

In her legal considerations, Christina explained that pretrial ruling number 99/Pid.Pra/2026/PN Jakarta Selatan—which served as the basis of the objection by Roy's defense team—only declared the search, arrest, and detention unlawful. The illegality of such coercive measures does not automatically nullify the authority of the prosecution or the validity of the indictment.

The judge emphasized that the validity of evidence obtained through an unlawful search would be assessed for its probative value during the trial on the merits, rather than serving as grounds to dismiss the indictment. Likewise, determining the statutory articles charged falls under the authority of the public prosecutor; fulfilling the elements of Article 32 and Article 35 of the Electronic Information and Transactions Law will be proved in the main trial hearings.

Prior to the interlocutory ruling, the Public Prosecutor had requested that the panel reject all objections from Roy's camp. During the hearing on Monday (5/10/2026), prosecutors assessed that the indictment satisfied both formal and material requirements. JPU representative Diffaryza explained that the indictment was structured chronologically in accessible language, while matters concerning the physical diploma, forensic laboratory examinations, and the Error Level Analysis (ELA) method pertain to evidentiary proof during the trial.

Indictment Stems from Three Posts in March 2025

In the indictment, the Public Prosecutor stated that the case began on March 26, 2025, when Jokowi was shown three posts—two YouTube videos and one post on social media X—alleging that his undergraduate degree was counterfeit. Roy allegedly applied the Error Level Analysis method without prior verification or confirmation with Jokowi, subsequently broadcasting the conclusion that the document was inauthentic.

The panel scheduled the next trial session for Wednesday (28/10/2026) at 09:00 Western Indonesia Time (Waktu Indonesia Barat / WIB) for witness examination. Roy Suryo was ordered to appear in person for the proceeding.

This interlocutory decision marks a new chapter in the legal case that has unfolded since mid-2026, following several previous pretrial motion losses by Roy's team regarding the handling of the investigation by the Jakarta Metropolitan Regional Police (Polda Metro Jaya) investigators.
